Zoning Hearing Board: Continuation of Case 536

Continuation of ZHB 536: The application of Deerfield Mowing and Property Maintenance Inc. seeking the following relief:  (1) An appeal from the June 10, 2025 zoning enforcement notice issued by the Zoning Officer for failure to obtain a permit for an agricultural structure and for a violation of the required side yard setback for an agricultural structure, and (2) in the alternative, a request for a variance from Section 240-1102.D.3. of the Kennett Township Zoning Ordinance to allow an agricultural structure to be located 16 feet from a neighboring property line where a 50-foot setback is required.  The subject property is located at 428 McFarlan Road, UPI Nos. 62-4-133, 62-4-134, 62-4-135 and 62-4-138 zoned SA (Special Agriculture), and UPI No. 62-4-139 zoned RS (Residential Suburban) consisting of 45 acres.
