The work session was called to order by Chairman Hammaker with Vice-Chairman Falcoff and Supervisor Elling all present.   

 

The Supervisors and Secretary-Treasurer reviewed all the items on the discussion list.

 

Mr. Hammaker moved to adopt Resolution 2008-12 regarding a grant application for the Kennett Area Park and Recreation Board.  Mr. Falcoff seconded the motion and it carried with all in favor.

October 20, 2008

 

Chairman Hammaker called the meeting to order at 7:30 p.m., with Vice-Chairman Falcoff present and Supervisor Elling all present.  

 

Mr. Hammaker moved that the minutes of the September 15, 17, and 24, 2008 and October 1, 8 and 15, 2008 meetings be approved as distributed, Mr. Falcoff seconded the motion and the motion carried with all Supervisors in favor. 

 

ANNOUNCEMENTS AND REPORTS

1)      Mr. Falcoff presented the public safety information data, gave the October 2008 Accident Summary as follows:

Miscellaneous:

Kaolin Rd.

Kaolin Rd. between Rt. 41 and 5 points was resurfaced on Sept. 26 and 29. The road also had centerline rumble strips, embedded centerline reflectors and side-of-road reflectors installed. Reduced speed limits had previously been implemented. There is noticeable improvement in vehicle traction in wet weather since the improvements. PennDOT is to be congratulated on the great job they did.

 

Rosedale Rd. and Bayard and McFarlan intersections

Installed blinking red lights on the stop signs to raise motorist awareness.

 

Rt. 82/US1/Cedarcroft Rd. intersections

Construction has begun on intersection signalization and the Cedarcroft interface with Rt. 82. construction should be completed by year-end.

 

Rt. 52/Hillendale Rd. intersection

Design activity continues. We anticipate project completion by Fall, 2009.

 

False burglar alarms

134 police calls in Twp. during September required police response- including 19 false burglar alarms; 14.2% of responses were a waste of police resources, needlessly putting them at risk and diminishing availability.

 

Well contamination at a McFarlan Rd. residence.

·   The contaminated well’s pumping regime has been modified to an on/off sequencing to better flush contaminated rock fractures.

·   September 25, 2008 test well sampling and hydrocarbon analysis show no contamination. Oil migration does not appear to be a problem at this point.

 

Pennsylvania One-Call Utility line protection

Pa One-Call does not mark private buried utilities such as propane or electric lines. As an example, propane lines from a tank to a standby power system must be marked by the propane supplier and are the homeowner’s responsibility.

 

- 1 criminal investigation.

- 42 routine assignments.

- 4 alarm activation calls.

- 4 automobile accidents responded to.

 

    These resulted in:

- 1 traffic arrest or citation.

 

State police activity is in addition to these incidents.

 

 

2)                  Mr. Hammaker announced that the Township received $87,023.56 for Fire Relief money which will be distributed 50/50 to Longwood Fire and Kennett Fire Companies.

 

NEW BUSINESS

 

Claire Finfrock of the Kennett Area Park and Recreation Board gave a presentation to the Township regarding the programs they are currently offering for children sports.

 

Marlyn Dietz of the Deer Committee gave a presentation to the Township on the establishment of the Deer Committee, their involvement in deer control and controlled hunting results in the Township.

 

ROADWORK

 

Municipal Cooperative of Southern Chester County – Bids

Mr. Elling moved to approve the following bid from the Municipal Co-op of Southern Chester County:

Eastern Salt Company for Road Salt in the amount of $14,770.00 for 200 tons.  Mr. Falcoff seconded the motion and it carried with all in favor.  Mr. Elling pointed out that the salt costs have increased from $55.79 per ton last year to $73.85 per ton this year.

 

Mr. Elling stated that the roadcrew has completed all paving and signs have been refaced, patching was completed on the roads, rubberized crack sealing was completed in four (4) subdivisions, Kaolin Road resurfacing project by PennDOT was completed, New yield signs were placed at both sides of the bridge at Hillendale Road, New flashing red and yellow lights were mounted on stop and intersection signs at McFarlan and Rosedale Roads, Trees were cleaned up, Sign damage was at a minimal, The new addition to the maintenance garage pole barn is near completion and they worked with Janice Taylor of KAPA on raceway cleanup.

 

 

 

SUBDIVISION/LAND DEVELOPMENT PLANS

  

Escrow Release

Mr. Hammaker moved to approve The Pines Escrow Release No. 2 in the amount of $115,231.41 with $729,796.37 remaining.  Mr. Falcoff seconded the motion and it carried with all in favor.

 

Extensions

Mr. Hammaker moved to approve the following extensions: 1) D’Agostino Property until 11/30/2008, and; 2) Delduco Property until 12/31/2008. Mr. Falcoff seconded the motion and it carried with all Supervisors in favor.

 

OTHER BUSINESS

 

Per Capita Tax

Mr. Hammaker moved to accept the Per Capita Tax removals per memos dated September 17 and 24, 2008 and October 15, 2008 and Per Capita Tax Additions per memo dated October 15, 2008.  Mr. Falcoff seconded the motion and it carried with all Supervisors in favor.

 

PUBLIC COMMENT

 

Turner Bell Property Discussion

Mr. Hammaker began this discussion by stating that since the enactment of the Open Space Tax the Township has collected $1,726,080 and in 2008 the Township funded $2,700,000 to the Kennett Township Land Trust (KTLT) for Open Space Purchases.  Since the beginning of the KTLT the Township has spent $11,379,504 on open space purchases and the KTLT operating costs.  Mr. Falcoff presented spreadsheet data showing all revenues and expenditures for the Open Space funding since 1998 and he reviewed the land preservation criteria.  Mr. Hammaker explained that soccer fields are needed in the area however an application has not been presented to the Township and if an application is presented they would need to apply to the Zoning Hearing Board for a Variance.   At the Turner Bell Property soccer fields are not a use by right in the Residential District.  Mr. Elling stated that the KTLT submitted a request to the Supervisors on October 16, 2008 for conservation funding for this property, which is currently under review.

 

Numerous residents were present that live in the area near the Turner Bell Property.  The residents all expressed the desire to keep the meadow open and object to having soccer fields.  Residents questioned when the decision will be made as to the funding and the Supervisors replied that they will try to come to a decision in one month. Steve Witsil of Witsil Realtors was present representing the Unionville Soccer League and he stated that there is not a formal agreement in place.  Hildy Montaigne pointed out that there are other land preservation organizations in the area other than the KTLT.  Mr. Witsil invited all of the residents to contact him with any questions or concerns.  Residents questioned how it was decided to spend previous open space monies, what was the criteria of other purchases and how many properties are being evaluated at the current time for funding. The residents submitted letters supporting preservation of the Turner Bell Property. Chet McCabe, Zoning Officer, explained that written letters to the Zoning Hearing Board hold no value, the residents would need to be present and testify at a hearing to be in the record. The KTLT stated that any funds that were to be provided for the Auburn Heights property can be eliminated and directed towards the purchase of this property.  The Board of Supervisors explained that they only committed to contribute $100,000 towards Auburn Heights.  Margot Chalfont of the EAC thanked Allan Falcoff for preparing the data for Open Space Funding and being transparent. 

 

 

 

ADJOURNMENT  

Mr. Hammaker acknowledged receipt of the financial statement for the prior month.  Mr. Hammaker moved that the bills be approved for payment, seconded by Mr. Falcoff, with all Supervisors in favor.
