SUPERVISORS PRESENT: R. Hammaker, A. Falcoff and M. Elling
CALL TO ORDER: The minutes from the April 7, 2009 meeting were approved as distributed.
ANNOUNCEMENTS:
1. There will be a Work Session on May 12th at 7:00 p.m. and Art Bernardon will give a presentation on Green buildings.

Jim Guthrie stated that he attended a meeting regarding
3. John Haedrich discussed the Kennett Bikeway project and stated that they are waiting for notification regarding additional funds. He stated that they are trying to get “Federal” stimulus funds for the project. John Haedrich stated that the traffic signal at Route 52 & Hillendale Road will be installed soon.
4. Bill Hewton discussed a meeting he attended regarding upcoming technology for Libraries held by the Bayard Taylor Library.
5. Sara Meadows of the Historic Committee stated that they will have an American Indian Program on May 28th at 7:00 p.m.

Conditional Use
Barry Stingel, Hillcrest Associates, presented this
proposal to use the building as a professional office located on Kennett Pike.
The applicant is also applying for a Zoning Variance to permit the
parking in the front of the building.
Jim Przywitowski moved to
recommend Conditional Use approval to the Board of Supervisors for a business
professional use of a preexisting structure with historical significance with
the following conditions: 1) The applicant would maintain compliance with all
Zoning Ordinance standards including any relief and/or conditions imposed at the
June 3rd Zoning Hearing Board meeting (Case Number 449), 2) The
applicant will enhance the landscaping around the proposed parking area to
minimize impact from Route 52 and adjacent properties, 3) The applicant will
implement minimum lighting required to conform to Township Ordinances,
4) The applicant would be permitted to waive the market analysis,
historic impact study and traffic impact study requirements of the Conditional
Use. Jim also noted that the

building. Bob Listerman seconded the
motion and it carried with all in favor.

Barry Stingel, Hillcrest Associates, presented this proposal to add 16 doubles to the existing mushroom facilities on Norway Road. He stated that they are working on the stormwater management. All action was deferred.

Matt Sabo gave an update on the proposal stating that Gilmore Associates submitted a review letter and they are waiting for a letter from URS and Anne Walters, with Sally Gardner of Advanced Geo Services present. The Planning Commission agrees with Gilmore’s approval to grant the waivers requested. Matt Sabo discussed the issue of impervious surface coverage which is currently under the previous Ordinance requirements. It was requested that the applicant provide a declaration of covenants to eliminate further paving on the property because the proposed impervious coverage is near the allowable limit. All action was deferred.

Bill Hewton presented this proposal to build a family style restaurant located on Route 52 at Mendenhall. He stated that Gimore Associates has recommended approval of the plan once URS and Anne Walters approve the revised plans. All action was deferred.
Shepherd Property – Conditional Use – Article XVII
Matt Sabo presented this proposal to create 12 lots including one lot with historic interest under Open Space Design Option Article XVII with David Shepherd, applicant, and Mark Pedulla, Regester Associates, present. Mr. Shepherd reviewed the process of the project to date. Mark Pedulla stated that they are using the plan from the Brandywine Conservancy. He stated that they will meet with Anne Walters to discuss landscaping prior to Preliminary Plan submission. Mark Pedulla requested a waiver for the number of units in a cluster and approval of the site design. The applicant will discuss the road design with the Fire Marshal and the Roadmaster. The Commission & Gilmore Associates supports the requested waivers and the proposed layout. John Haedrich discussed the need to deed restrict the rear of the lots to maintain the view sheds. Dave Shepherd requested that an approved plan allow for the subdivision of one future lot should the Zoning Ordinance be revised. The Commission will discuss the issue with Bob Adams prior to the June meeting. A homeowner association is planned for this development. All action was deferred.

Jim Guthrie presented this proposal to create 24 townhouses on 9.33 acres located on Union Street in the R-4 district with no one present representing the applicant. Revised plans were submitted and the easement has been executed from Phillips Mushroom regarding the stormwater. All action was deferred.

Bill Hewton presented this proposal to construct a 2 bay carwash located on Millers Hill. He stated that the applicant is working on revisions to the plans and an extension has been received. The Borough of Kennett Square is reviewing the quality of flow from the project. There are still outstanding issues from Gilmore Associates and URS. Anne Walters is currently reviewing a revised landscaping plan. All action was deferred.

have been working with Luthern Home to determine if this proposal located on

Tim Cassidy, Bernadon Habor Holloway, presented a sketch plan for the proposed conditional use application for expansion of the campus with 48 units. The exiting entrance will be abandoned and a new loop road will be created to service the new units. The new units will be duplexes and there will be outdoor walking systems. A formal Conditional Use application will be submitted within one week. The Commission is in favor of waiving the requirement of a traffic and market study once the application is submitted. Kendal has adequate sewer capacity for the proposal. Jim Guthrie expressed concerns with the amount of units on the access road without a second exit.
