PLANNING COMMISSION MINUTES

 

March 3, 2009

SUPERVISORS PRESENT:  R. Hammaker, A. Falcoff and M. Elling

 

CALL TO ORDER:  The minutes from the February 10, 2009 meeting were approved as distributed. 

 

ANNOUNCEMENTS:

 

1.      There will be a Work Session on March 10th at 7:00 p.m.

 

2.      Bill Hewton gave an update from the Kennett Area Regional Planning Commission providing on aval reports that New Garden Township Open Space Review Board and New Garden is also proceeding with a large commercial development at the intersection of Route 7 and 41, Borough of Kennett Square has raised taxes to meet budget and Pocopson is considering enacting an earned income tax.

 

3.      John Haedrich discussed the proposed V-1 Zoning District amendment to eliminate the restriction of the 200 ft. setback making minor changes.  The Historic Commission will review the proposed changes, the uses should be explored.  Jim Przywitowski moved to recommend to approval of the recommended V-1 Ordinance to the Board of Supervisors conditioned upon the CCPC, Township Solicitor approval and review by the Historic Commission.  Bob Listerman seconded the motion and it carried with all in favor.

Chris Alonzo presented this proposal to build a restaurant located on Route 52 at Medenhall.  Adam Brower, applicant’s engineer, reviewed the status of the proposal stating that they are working on the sewage and landscaping issues.  The applicant will follow the CCHD procedure for abandoning four (4) holding tanks.  Homeowners from Deerfield discussed the need for screening due to potential lights and noise.  This issue needs to be addressed.  Anne Verplanck explained to the residents that since they live next to an existing commercial property and they should consider planting trees on their properties.  All action was deferred.

 

Shepherd Property – Conditional Use – Article XVII

 

Bill Hewton presented this proposal to create 12 lots and one lot will contain the historic house under Open Space Design Option Article XVII with David Shepherd present.  Mr. Shepherd stated that he is continuing to work on his proposal. All action was deferred.

Jim Guthrie presented this proposal to create 24 townhouses on 9.33 acres located on Union Street in the R-4 district. Wendy MacLean and David D’Agostino were present and gave an update on the project stating that there was discussion regarding the parking in the driveway blocking pedestrian access so the affected units will be moved back.  The Township will send the open space management plans to the Brandywine conservancy for review, testing will be done on infiltration bed #2 and a drainage easement agreement was submitted to the Township.  Albert McCarthy, Township Police Chief and Roger Lysle, Roadmaster, discussed the issue with emergency vehicles accessing the houses due to the design of the development and parking.  He stated that the grass strip causes problems for the road plows to turn around.  The roads will not be dedicated to the Township.  John Snook pointed out that the circle is wider than a normal cul-de-sac.  An extension letter was submitted.

Bill Hewton presented this proposal to construct a carwash located on Millers Hill and stated that review letters were issued from Gilmore Associates, URS and Anne Walters all with outstanding issues.  Gilmore Associates has met with Concord Planning to discuss these issues. He stated that the applicant is working on revisions to the plans. All action was deferred.

 

Greenwood Mushrooms - Land Development - Preliminary

Jim Przywitowski presented this proposal to add 16 doubles to the existing mushroom facilities on Norway Road and stated that the applicant is currently revising the plans for submission.   All action was deferred. 

 

Clemens Property - Subdivision - Preliminary

Anne Verplanck presented this proposal to create one additional lot located on Bayard Road with Ed Clemens present.  She stated that the applicant is revising the plans for submission.  All action was deferred.

 

Speakman Property – Sketch

 

Neil Caymans of Chester Valley Engineers and John Mezzanotte, attorney, presented a sketch plan containing 17 lots on 63 acres.  John Snook explained the time line of the proposal.  Matt Sabo discussed the intrusion on the forest interior habitat and that there is a gas pipe line which will need to be crossed.  Bob Listerman stated

that Burnt Mill Road is very narrow and needs to be considered in development.  Anne Verplanck pointed out that removing one house may dramatically improve the layout.  There are more than eight (8) houses in one of the clusters which will need to be addressed. Jim Guthrie asked that thought be given to how the balance of the property will be maintained.  The EAC will schedule a meeting to discuss maintenance of the property. 

 

Whiteside Property – Sketch

 

Brian Connoley and Art Ebedesian presented a sketch to create three lots on 21.6 acres, two lots containing 9.5 acres each and one lot containing 2 acres.  The subcommittee will hold a site walk March 7th at 9:30 a.m.

 

Kennett Business Park Final - LD

 

Matt Sabo gave an update on the proposal stating that Preliminary Plans were approved last summer by Kennett Township and the applicant has recently received Borough approval.  The applicant will move forward to Final Plan submission.

 

Case Property – Sketch

 

Bill Hewton stated that the subcommittee is trying to establish a meeting with the applicant to discuss the proposal.
