PLANNING COMMISSION MINUTES

 

October 7, 2008

SUPERVISORS PRESENT:  R. Hammaker and A. Falcoff  Absent: M. Elling

 

CALL TO ORDER:  The minutes from the September 2, 2008 meeting were approved as distributed. 

 

ANNOUNCEMENTS:

 

1.   There will be a Work Session on October 14, 2008 @ 7:00 p.m. with the Board of Supervisors.

 

  1. The November Planning Commission meeting will be held on November 11, 2008 @ 7:00 p.m. due to Election Day and the Work Session will be held on November 18, 2008 to discuss Historic Survey & Comprehensive Plan.

 

  1. Bob Listerman gave an update on the Regional  Act 537 Plan stating that the Board of Supervisors have agreed to adding a 550,000 gpd pod to the Kennett Square Borough Treatment Plant. In the meantime a committee will be formed to continue exploring spray irrigation options. 

 

  1. John Haedrich stated that the Bikeway Project will have a report ready for the October or November Board of Supervisors meeting. 

 

SUBDIVISIONS AND LAND DEVELOPMENTS

 

Speakman Property – Subdivision – Sketch

 

Jim Guthrie gave an update on the proposal stating that the subcommittee met with the applicant and the Brandywine Conservancy.  The Brandywine Conservancy presented a sketch plan for 17 units which will be presented to the Planning Commission in the near future.  Hildy Montaigne of the EAC asked that the woodlands be protected. 

 

Hionis Property – Land Development – Final

Bill Hewton presented this proposal to build a restaurant located on Route 52.  No one was present representing the applicant.  All action was deferred.

 

Shepherd Property – Conditional Use – Article XVII

 

Bill Hewton presented this proposal with Mr. Shepherd present.  An extension is in placed until 12/1/2008.  The applicant is proposing 12 lots and one lot will contain the historic house under Open Space Design Option Article XVII. All action was deferred.

 

D'Agostino Property - Subdivision - Preliminary

Jim Guthrie presented this proposal to create 24 townhouses on 9.33 acres located on Union Street in the R-4 district.  No one was present representing the applicant. The Commission noted the review letter from the Fire Marshal.  The Commission does not necessarily agree with all the recommendations.  The points should be considered with the review of the Township Engineer.  All action was deferred.

 

Delduco Property – Land Development – Preliminary

Bill Hewton presented this proposal to construct a carwash located on Millers Hill and stated that revised plans were submitted.  No one was present representing the applicant.   Bill Hewton moved to deny the plans due to the unresolved issues in Gilmore Associates letter dated 7/31/2008 and URS letter dated 6/19/2008 unless an extension letter is submitted by October 10, 2008 by Noon.  Matt Sabo seconded the motion and it carried with all in favor.

 

Corrective Chiropractic – Land Development – Sketch

This property is located on Gap-Newport Pike in both Kennett and New Garden Townships.  Dr. Lawrence of Corrective Chiropractic would like to demolish the existing structure which is dilapidated and build a new Chiropractic facility.  The property is zoned Residential in Kennett Township and Commercial in New Garden Township.  The subcommittee team 1 will schedule a site walk.

 

Porter Property – LD – Sketch

Jim Guthrie presented this proposal to make a lot line change to add property to lot 1 from lot 2 so the garage can be constructed on lot 1.  A site walk was conducted and the applicant was advised to proceed with the required Variance and then apply for a Final Minor Lot Line Change Plan.  Mr. Brown represented the applicant and submitted a revised sketch plan.  Jim Guthrie stated that the Planning Commission will review the sketch and give their opinion.

 

Turner Bell Property

Jim Guthrie recognized a group of residents who wished to better understand a possible change in use for the property at the corner of Sills Mill and Hillendale Roads.  Discussion among the Commission and with the audience stated that there was no application before the Commission for this property and that if some future use which is not permitted by the current zoning is submitted; the standard review steps would have to be followed to consider whether such a use could be accommodated.  In recognition that some application activity may be initiated on this property, the residents were encouraged to sign up for the Events email notification service available via the Township web site.
