ORDINANCE NO. 182

 

AN ORDINANCE OF KENNETT TOWNSHIP, CHESTER COUNTY, PA. AMENDING ORDINANCE NO. 166, THE ZONING ORDINANCE OF KENNETT TOWNSHIP BY AMENDING  V-1 DISTRICT – HAMORTON TO DELETE THE 200 FT. MAXIMUM  SETBACK REQUIREMENT.

 

The Board of Supervisors of Kennett Township hereby enact and ordain the following amendment to the Kennett Township Zoning Ordinance, Ordinance No. 166.

 

Section 1.  Article VIII, Section 801 C (11) Delete in line 1 “property” and replace with “parcel” and in lines 4, 5, and 6 delete “In addition, the use, including the principal building associated parking and accessory structures, shall be located a maximum of 200 feet from the right-of-way of either Route 1 or Route 52,” so that the amended Section 801 C (11) will read as follows:

 

(11)   The following uses shall be permitted in the V – 1 Village District if the parcel on which the use is located has  frontage on Route 52 or Route 1, and the use is located substantially within a structure in existence  on the effective date of this ordinance, and can meet other applicable requirements of this ordinance.

 

(a)      Business or professional office.

 

(b)      Neighborhood commercial uses, including retail stores and retail services, not to exceed 2,000 square feet of floor area.

 

(c)      Residential use above a professional or administrative office or retail use. Such use shall also be subject to the applicable provisions of Z-1926, Mixed  use proposal.

 

(d)     Banking or financial institution.

 

(e)      Catering establishment

 

(f)       Personal service establishment.

 

ENACTED AND ORDAINED this 20th day of April, 2009.
