ORDINANCE 156
AN ORDINANCE OF
ON THE OPERATION OF LARGE
WHEREAS, pursuant to the provisions of the Motor Vehicle Code, 75 Pa.C.S.A.
§ 6109(a) and (b),
permitting local authorities, by ordinance, to exercise their police power on
streets and highways within their physical boundaries, including
§ 6109(a)(7) which
permits a local authority to prohibit or restrict the use of highways at
particular places by particular classes of vehicles whenever the highway, or a
portion thereof, may be seriously damaged by the use or movement of such
vehicles which would constitute a safety hazard; and
WHEREAS, under the provisions of
§ 6109(e), action
by local authorities shall be taken only after completing an engineering and
traffic investigation; and
WHEREAS, McCormick Taylor, engineers and planners, have performed an
engineering and traffic investigation on Cedarcroft Road within Kennett
Township, between Mill Road and Route 82, to determine if certain vehicles
should be restricted from using Cedarcroft Road; and
WHEREAS, based upon the observed operations of the roadway, McCormick
Taylor found that the presence of oversized vehicles within two-way traffic
causes one or both vehicles to ride on the extreme edge of the pavement and
occasionally leave the paved cartway, resulting in observed pavement edge
damage; and
WHEREAS, McCormick Taylor has found that the operation of large trucks on
Cedarcroft Road creates an undesirable condition where vehicles drive along the
edge of the paved roadway, resulting in weakening and deterioration of the
pavement and has recommended that vehicles wider than 96 inches (8 feet) be
prohibited from using Cedarcroft Road between Mill Road and Route 82.
NOW, THEREFORE, it is hereby enacted and ordained as follows:
SECTION 1. Vehicles
wider than 96 inches (8 feet) including mirrors, with the exception of school
buses, shall be prohibited from using
SECTION 2. This
prohibition shall be accomplished with four sign installations, each consisting
of an R5-2 ("No Trucks") sign mounted above an R14-16-1 ("Width Prohibition")
sign. Two such signs shall be
installed on each side of
