ORDINANCE NO. 146

 

AN ORDINANCE AMENDING THE SUBDIVISION AND LAND DEVELOPMENT ORDINANCE OF KENNETT TOWNSHIP, BY MODIFYING AND EXPANDING THE  STANDARDS FOR STREET WIDTHS, AND BY ADDING STANDARDS FOR ON-STREET PARKING, PARKING AREAS AND PARKING LOTS, AND LANDSCAPING.

 

The Board of Supervisors of Kennett Township hereby enacts and ordains the Subdivision and Land Development Ordinance of Kennett Township, Ordinance No. 46, as adopted August 15, 1983, as amended, be amended further as follows:

 

SECTION 1.

 

Amend Article V, DESIGN STANDARDS, Section 502.2 STREET WIDTHS, by deleting in its entirety and replacing with the following:

502.2 STREET WIDTHS

A.         Minimum street right-of-way and pavement widths shall be as shown on the "Official Plans" or if not shown on such plans, shall be as follows:

2.          Or as specified in the "Official Plans" or as determined after consulting with the Township, the County Planning Commission and the Pennsylvania Department of Transportation.

3.          See §502.8 for cul-de-sac areas.

B.         Additional right-of-way and pavement widths may be required by the Township Planning Commission or Board for the purpose of promoting the public safety and convenience, or to provide parking in commercial and industrial areas and in areas of high density residential development, or to provide space needed for approved on-street parking in accordance with § 1402-C of the Kennett Township Zoning Ordinance.

SECTION 2.

 

Amend Article V, DESIGN STANDARDS, by adding a new Section 518 PARKING AREAS AND PARKING LOTS, as follows:

518      PARKING AREAS AND PARKING LOTS

A.        The design standards specified below shall be required for all off‑street parking facilities with a capacity of ten (10) or more vehicles built after the effective date of this Ordinance.

 

B.         All parking areas and parking lots shall be in accordance with the requirements of Article XIV Design Standards as set forth in the Zoning Ordinance, and the following:

 

            1.         The minimum dimensions of stalls and aisles shall be as follows:

2.          Parking areas shall be designed to permit each motor vehicle to proceed to and from the parking space provided for it without requiring the moving of any other motor vehicles.

3.         The drive aisles and other areas which define traffic movement in all parking lots shall be divided and defined by permanent raised curbs and planting strips so that access lanes are clearly defined, and that moving traffic is confined to designated access lanes.  The Board of Supervisors may require the installation of cast-in-place concrete curbs around the perimeter of parking stalls, upon the recommendation of the Township Engineer.

 

4.         All parking spaces for handicapped use shall have an area of at least forty-five (45) square feet (14’ x 17.5'), whereby the stall shall be at least eight (8) feet in width and a line striped area shall be at least six (6) feet in width on the passenger side of the stall with an assumption that the vehicle is parked with the front end in.  All such parking spaces shall comply with all requirements of the Americans with Disabilities Act (ADA) relative to signage, pavement gradient and the like.

 

5.         No one area for off‑street parking of motor vehicles shall exceed sixty (60) spaces in capacity.  All sixty (60) space parking areas shall be separated from each other by a ten (10) foot wide minimum landscaped planting strip.

 

6.         No more than ten (10) parking spaces shall be permitted in a continuous row without being interrupted by a landscaping planting strip at least ten (10) feet in width for interior islands.

 

7.         In those areas within a parking lot where vehicles are parked and in aisles adjacent to parking, a maximum grade of five (5) percent shall not be exceeded.  Parking aisles not directly adjacent to parking and access driveways within a parking lot shall not exceed a grade of eight (8) percent.  No grade cut, fill, or height difference between terraced parking areas shall exceed three (3) feet unless separated by landscaped areas with slopes no greater than 5:1.

 

8.         Entrances and exits to and from off‑street parking areas shall be located so as to avoid interference with street traffic.

 

9.         For the purpose of servicing any non‑residential property held under single and separate ownership, entrance and exit drives crossing the right-of-way line shall be limited to four (4) along the frontage of any single street, and their center lines shall be spaced at least one hundred (100) feet apart.  On all corner properties, there shall be a minimum spacing of one hundred (100) feet, measured at the curb line, between the center line of any entrance or exit drive and the right-of-way line of the street parallel to said access drive.

10.       The width of entrance and exit drives shall be:

 

a.         A minimum of fourteen (14) feet for one‑way use only;

 

b.         A minimum of twenty-five (25) feet for two‑way use;

 

11.       No less than a five (5) foot radius of curvature shall be provided for all curb lines for interior islands and no less than a seven (7) foot radius shall be used in all other cases.

 

12.       All dead‑end parking areas shall be designed to provide back‑up and turn around areas for the end stalls of the parking area and shall be clearly marked "No Parking". 

 

13.       All parking spaces shall have pre-cast concrete wheel stops that are anchored to prevent vehicle encroachment onto sidewalks and/or landscaped areas.  Such wheel stops shall be installed and maintained at a minimum distance of 18 inches from the end of the parking space in the case of 90o parking, and as otherwise shown in the Appendix Exhibit for angled parking spaces.

 

14.       All materials used in the construction of parking areas shall comply with § 502.6 relative to Street Construction. 

 

15.       All parking areas shall be landscaped in accordance with Section 519.

 

SECTION 3.

 

Amend Article V, DESIGN STANDARDS, by adding a new Section 519 LANDSCAPING, as follows:

 

519      LANDSCAPING

A.         Parking Lot Landscaping.  The following regulations shall apply to all parking lots with ten (10) or more vehicles:

 

1.          The outer perimeter of parking areas shall be screened.  Effective screens shall be accomplished through the use of plant materials, fencing or walls and/or mounding through the use of earthen berms.

2.          Off-street parking areas and parking lots shall be landscaped to reduce wind and air turbulence, heat and noise, and the glare of automobile lights; to reduce the level of carbon dioxide; to provide shade; to ameliorate stormwater drainage problems; to replenish the groundwater table; to provide for a more attractive setting; and to provide for public safety.

 

3.          Parking areas shall be landscaped.  Each parking lot shall have one (1) two to two and one-half (2 - 2 1/2) inch caliper shade tree for every five (5) parking spaces. 

 

4.          Shrubs, groundcovers and other plant materials are encouraged to be used to complement the required shade trees, but shall not be the sole contribution to the landscaping.

 

5.          The type of plant materials to be used shall be subject to review and approval by the Board of Supervisors upon the recommendation of the Planning Commission.  However, native plant materials shall be used to the maximum extent possible.

 

B.         Landscape Plans for parking lots shall be submitted at the time when all other required applications and/or plans are submitted.  Plans shall be based on and reflect the following:

 

1.          The functional and aesthetic factors which relate to the tract.

 

2.          Concealing visibility of parking areas.

 

3.          Using plant materials which are hardy and acclimated to the conditions at the tract and within the Township.

 

C.        A Landscape Plan shall include notes, diagrams, sketches, or other depictions to present the consideration and analysis of the following:

 

1.          An analysis of the site in terms of:  the existing views to and from the areas which are proposed for development; existing topography and vegetation conditions; and, other existing conditions which are relevant to the site.

 

2.          An analysis of proposed planting and other landscaping needs as related to:  screening parking areas and other areas where vehicles are parked.

 

3.          Requirements and standards for landscaping, in addition to that specified above, shall be as determined by the Board of Supervisors.  The Board may require plantings:  to reduce glare; to abate other nuisances; to enhance the planting area in conjunction with streets; and to fulfill screening and other functional purposes.

4.          The location, type, size, height and other characteristics of landscaping shall be subject to the review and approval of the Board of Supervisors.

 

D.        The Preliminary Landscape Plan shall be prepared by a Registered Landscape Architect and shall be drawn at a scale of at least 1” = 50’.  It shall be totally coordinated with the overall site plan in terms of its relationship to proposed buildings, roads, parking areas, walks, fencing, benches, signs, lighting and other like structures and shall contain the following:

 

1.          A delineation of existing and proposed plant materials.

 

2.          A delineation of all trees and other vegetation to be removed.

 

3.          A delineation of tree protection areas where snow fence or other temporary fence is placed.

 

E.         A Final Landscape Plan shall be prepared by a Registered Landscape Architect and shall be submitted after the Township has reviewed the Preliminary Landscaping Plan and submitted comments on the plan to the Applicant.  The Final Landscaping Plan shall be drawn at a scale of 1”=50’ maximum.  It shall be totally coordinated with the overall site plan and shall contain the following:

 

1.          A final version of all of the plan requirements stated in Section 519.D. above, for a Preliminary Plan.

 

2.          A “Plant List” wherein the botanical and common name of proposed plants are tabulated, along with the quantity, caliper, height, spread, and other dimensions and characteristics.

 

3.          Details for the planting and staking of trees, and the planting of shrubs, and any other details which depict other related installation or protection, such as groundcover spacing, tree fencing, tree grates and guards, tree wells and the like.

 

4.          Information regarding the continued maintenance of all plantings, and notes indicating that all plantings will be installed, maintained, and replaced if dead or diseased in the same locations as shown on the approved Landscape Plan.

 

F.         Plant Characteristics and Maintenance

 

1.          All plants shall conform with the “American Standard for Nursery Stock” of the American Association of Nurserymen, latest edition.

2.          Trees and shrubs shall be typical of their species and variety; have normal growth habits, well developed, densely foliated branches, and vigorous, fibrous root systems.

 

3.          Trees and shrubs shall be free from defects and injuries and certified by appropriate Federal and State Authorities to be free from diseases and insect infestations.

 

4.          Trees and shrubs shall be freshly dug and nursery grown.  They shall have been grown under climatic conditions similar to those in the locality of the project or properly acclimated to conditions of the locality of the project.

 

5.          Any tree or shrub which is deemed, in the opinion of the Township, not to have survived or grown in a manner characteristic of its type, shall be replaced.  Substitutions for certain species of plants may only be made when approved by the Board of Supervisors, and recommended by the Township Landscape Architect.

 

6.          It shall be the responsibility of the landowners, developers, tenants and/or other occupants of the premises to adequately and properly maintain the landscaped areas, in accordance with any Homeowners Association Agreement, Property Owners Association Agreement, or other Agreement.
