ORDINANCE NO. 143

AN ORDINANCE ADOPTING AN AMENDMENT TO THE ZONING MAP OF KENNETT TOWNSHIP, CHESTER COUNTY, PENNSYLVANIA, TO CHANGE THE ZONING CLASSIFICATION OF A PORTION OF THE PROPERTY OF HELEN E. AND THOMAS E. MARTIN, JR. SITUATE AT W. BALTIMORE PIKE FROM C COMMERCIAL DISTRICT CLASSIFICATION TO R-4 RESIDENTIAL DISTRICT CLASSIFICATION.

 

IT IS HEREBY ENACTED AND ORDAINED by the Board of Supervisors of Kennett Township, Chester County, Pennsylvania that the Zoning Map of Kennett Township which is referred to in Section 301 of the Zoning Ordinance of Kennett Township, as both Map and Ordinance have been amended, is hereby amended as follows:

SECTION 1. The following described property shall be changed in classification from the C Commercial District classification (as described in Article X of the Zoning Ordinance) to the R-4 Residential District classification (as described in Article VII of the Zoning Ordinance):

BEGINNING at a point in the westerly property line of lands now or formerly Helen E. and Thomas E. Martin, Jr., also the New Garden Township Line, and said point being located the following course and distance from a pipe which is located on the title line within Baltimore Pike, S.R.3048, width varies, and said Westerly property line of said parcel.

a)                 Leaving said pipe, along said westerly property line, North 02 degrees 04 minutes 00 seconds a distance of 201.99 feet, said point being the BEGINNING point of the herein described new R-4 zoning district parcel;

THENCE 1)          Along said westerly property line, North 02 degrees 04 minutes 00 seconds East, a distance of 201.10 feet to a point;

THENCE 2)          Leaving said westerly property line, North 86 degrees 05 minutes 00 seconds East, a distance of approximately 1243.63 feet to a point, said point on the Kennett Square Borough line;

THENCE 3)          Along said Borough line, South 01 degrees 23 minutes 16 seconds East, a distance of 259.79 feet to a point;

THENCE 4)          Leaving said Borough line, South 89 degrees 05 minutes 37 seconds West, a distance of 237.77 feet to a point;

THENCE 5)          Along same, North 00 degrees 54 minutes 23 seconds West, a distance 116.74 feet to a point;

THENCE 6)          Along same, South 89 degrees 05 minutes 37 seconds West, a distance 142.16 feet to a point;

THENCE 7)          Along same, South 00 degrees 54 minutes 23 seconds East, a distance 340.83 feet to a point, in said northerly right-of-way line of Baltimore Pike.

THENCE 8)          Along said title line within Baltimore Pike South 89 degrees 05 minutes 37 seconds West, a distance 740.09 feet to a point, said point being the Southeasterly property corner of lands now or formerly Richard E. and Patricia A. Swift.

THENCE 9)          Leaving said northerly title line within Baltimore Pike, along the Easterly property line of Richard E. and Patricia A. Swift, North 04 degrees 24 minutes 30 seconds West, a distance 224.50 feet to a point;

THENCE 10)        Along the northerly property line of Richard E. and Patricia A. Swift, and WM. W. Fahey Post Home Corp. South 86 degrees 05 minutes 00 seconds West, a distance of 502.64 feet to the first mentioned point and place of BEGINNING.

CONTAINING 510,816.32 Square feet of Land.

SECTION 2.  The Zoning Map of Kennett Township shall be modified by the Kennett Township Engineer to include the property described in Section 1 above to establish and/or verify the precise limits of the foregoing amendment, which modification shall be conclusive as to the extent of such Map change.
